Last year, we published an article [1] detailing the reforms to the Strata Schemes Management Regulation 2016 (NSW) and Community Land Management Regulation 2018 (NSW) following the impacts of COVID-19.

On 1 June 2022, the Strata Schemes Management Amendment (COVID-19) Regulation 2022 (SSMA Reg 2022) [2] and Community Land Management Amendment (COVID-19) Regulation 2022 (CLM Reg 2022) [3] came into effect – both of which repealed and replaced their predecessors.

In summary, the changes brought by the SSMA Reg 2022 and CLM Reg 2022 are as follows:

  • Alternative arrangements for voting at strata meetings or association meetings – Voting at strata meetings or association meetings can continue to be held electronically.
  • Alternative to affixing seal of owners corporation or association – An instrument or document can continue to be signed and witnessed electronically instead of having to affix the seal of an owners corporation or association.

The SSMA Reg 2022 and CLM Reg 2022 will cease to be in effect after 30 September 2022.
